OnCourse Eats Terms & Conditions

These Terms & Conditions (the “Terms”) govern your access to and use of the OnCourse Eats website, mobile ordering experience, text messaging program, and related services (collectively, the “Services”). The Services are operated by Gemint LLC, doing business as OnCourse Eats (“OnCourse Eats,” “we,” “us,” or “our”).
By accessing or using the Services, placing an order, or agreeing to receive text messages from us, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and Service Area
You must be at least 18 years old and legally capable of entering into a contract to use the Services. Alcohol may be purchased or received only by persons who are at least 21 years old and satisfy all identification and other legal requirements.
The Services are intended for use at participating golf courses and facilities in locations where OnCourse Eats operates. Availability varies by course, location, date, operating hours, kitchen capacity, weather, staffing, and other conditions.
2. How the Services Work
OnCourse Eats provides an on-course food and drink ordering and delivery service in partnership with participating golf courses and their food-and-beverage operations. Golfers may use the Services to view available menu items, place an order, provide their current or anticipated location, and receive an order at an upcoming hole or another designated delivery point.
The participating golf course or its food-and-beverage operator is responsible for the menu, item preparation, food quality, ingredient and allergen information, pricing, and legal sale of regulated products. OnCourse Eats facilitates the ordering experience and coordinates delivery as described for the applicable course.
Delivery locations and timing are estimates, not guarantees. We may contact you to confirm your location or direct you to a safe and practical handoff point.
3. Orders, Availability, and Changes
All orders are subject to acceptance and availability. Menu items, prices, hours, delivery zones, order cutoffs, and estimated delivery times may vary by course and may change without notice.
You are responsible for reviewing your order before submitting it and for providing complete and accurate information, including your mobile number, current hole or location, identifying details, and any delivery instructions. If you change holes, leave the course, lose mobile service, or cannot be located, delivery may be delayed, redirected, or made available for clubhouse pickup.
We or the participating course may reject, modify, or cancel an order because of item availability, operational constraints, suspected fraud, safety concerns, legal requirements, or an obvious pricing or listing error. If a paid order is canceled, the applicable seller will provide any refund required by law.
4. Prices, Payment, Taxes, and Tips
Prices, taxes, service or delivery fees, and optional tips will be shown before you submit an order. By placing an order, you authorize the applicable payment processor to charge the payment method you provide for the total amount shown.
Payments may be processed by a third-party payment provider. OnCourse Eats does not directly store complete payment-card numbers. Your use of a third-party payment service may also be governed by that provider’s terms and privacy policy.
5. Cancellations, Refunds, and Order Issues
Because participating courses may begin preparing orders promptly, cancellations and changes are not guaranteed after submission. Refunds, replacements, or credits for missing, incorrect, unavailable, or unsatisfactory items are determined by OnCourse Eats and/or the participating course, subject to applicable law.
To report an order issue, contact us promptly at jason.barrera@oncourseeats.com and include the course, order number, and a brief description of the issue.
6. Alcoholic Beverages
Alcohol availability varies by course and jurisdiction. If an order contains alcohol:
- You must be at least 21 years old and the intended recipient of the order.
- You must present a valid, government-issued photo ID at delivery upon request.
- The recipient must not appear intoxicated, and delivery must otherwise comply with course policy and applicable law.
- Alcohol may not be left unattended or delivered without any required age verification.
We or the participating course may refuse or cancel an alcohol sale or delivery if these conditions are not met. Refund availability may be limited where refusal results from failure to satisfy age, identification, sobriety, or other legal requirements.
7. Text Messaging Terms
By providing your mobile number and affirmatively consenting where consent is requested, you agree that OnCourse Eats may send text messages related to the Services. Messages may include verification codes, order confirmations, receipts, order-status updates, delivery coordination, customer-support messages, and, only if you separately opt in, promotional messages.
Message frequency varies based on your orders, account activity, support requests, and messaging preferences. Message and data rates may apply. Consent to receive promotional text messages is not a condition of purchase.
You may opt out of text messages at any time by replying STOP. You may request help by replying HELP or emailing jason.barrera@oncourseeats.com. We may send one final message confirming an opt-out request. We will honor opt-out and other reasonable revocation requests as required by law. After opting out, we will not send additional text messages unless you later provide consent again or the message is otherwise permitted by law.
You represent that you are the subscriber or customary user of the mobile number you provide and that you are authorized to consent to messages at that number. If your number changes or is reassigned, you agree to update or remove it promptly. Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Do not share verification codes with anyone. OnCourse Eats will not ask you to provide a verification code by phone, email, or text outside the sign-in or order-confirmation process you initiated.

8. Safe and Acceptable Use
Use the Services only when it is safe and lawful to do so. Do not use your phone while driving a golf cart or operating any vehicle. Follow all course rules, staff instructions, cart-path restrictions, and safety requirements.
You may not:
- Use the Services for unlawful, fraudulent, abusive, or harmful activity;
- Interfere with the Services or attempt to access systems or data without authorization;
- Submit false location, identity, age, payment, or order information;
- Copy, scrape, reverse engineer, or commercially exploit the Services except as permitted by law; or
- Impersonate another person or misuse another person’s account, phone number, or payment method.
9. Intellectual Property
The Services and their content, branding, graphics, software, and other materials are owned by OnCourse Eats or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable, revocable right to use the Services for their intended purpose.
10. Third-Party Services and Course Policies
The Services may link to or rely on services operated by participating courses, payment processors, communications providers, mapping providers, analytics providers, or other third parties. We are not responsible for third-party services, and their separate terms and policies may apply.
Your presence and conduct at a participating course remain subject to that course’s rules, policies, waivers, and instructions.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” OnCourse Eats disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not guarantee uninterrupted access, item availability, exact delivery times or locations, uninterrupted mobile coverage, or that the Services will be error-free. Food preparation, ingredients, allergens, and dietary representations are controlled by the participating course or food-and-beverage operator. If you have a food allergy or dietary restriction, contact the participating course directly before ordering and do not rely solely on menu descriptions.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
12. Limitation of Liability
To the fullest extent permitted by law, OnCourse Eats and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the Services.
To the fullest extent permitted by law, OnCourse Eats’ total liability for any claim arising from or related to the Services will not exceed the greater of (a) the amount you paid through the Services during the three months before the event giving rise to the claim or (b) $100.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless OnCourse Eats and its owners, officers, employees, contractors, and agents from claims, damages, losses, liabilities, and expenses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person’s rights.
14. Suspension and Termination
We may suspend or terminate access to the Services if we reasonably believe you have violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or used the Services in a way that threatens safety or operations. You may stop using the Services at any time.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a legal claim, you and OnCourse Eats agree to make a good-faith effort to resolve the dispute informally by sending written notice describing the issue and requested resolution. Notices to OnCourse Eats must be sent to jason.barrera@oncourseeats.com.
Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the Services will be brought in the state or federal courts located in Los Angeles County, California, and each party consents to those courts’ jurisdiction and venue.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a revised effective date. If a change materially affects your rights, we will provide notice as required by law. Your continued use of the Services after the updated Terms take effect constitutes acceptance of the revised Terms.
17. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets. These Terms and the Privacy Policy constitute the entire agreement between you and OnCourse Eats concerning the Services, except for any additional terms presented for a specific feature or transaction.
