OnCourse Eats Privacy Policy

This Privacy Policy explains how Gemint LLC, doing business as OnCourse Eats (“OnCourse Eats,” “we,” “us,” or “our”), collects, uses, discloses, and protects information when you use our website, mobile ordering experience, text messaging program, customer support, and related services (collectively, the “Services”).

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

Information you provide

We may collect information you provide directly, including:

  • Contact information, such as your name, mobile number, and email address;
  • Order information, such as selected items, course, current hole or delivery location, cart or group details, delivery instructions, order history, and tips;
  • Account and verification information, such as login details and one-time verification codes;
  • Communications, including customer-support requests, survey responses, feedback, and records of text-message consent, preferences, and opt-out requests; and
  • Age or identity information when reasonably necessary to facilitate an age-restricted purchase, such as alcohol. A participating course may inspect identification at delivery without OnCourse Eats retaining a copy.

Payment information

Payments are processed by third-party payment processors. We may receive limited payment-related information, such as payment status, transaction identifier, card type, and the last four digits of a payment card, but we do not directly store complete payment-card numbers.

Information collected automatically

When you use the Services, we may automatically collect:

  • Device type, browser type, operating system, IP address, language, and general region;
  • Pages or screens viewed, links selected, referring page, timestamps, and interactions with the Services;
  • Cookie, local-storage, and similar technology data; and
  • Approximate or course-specific location information that you provide or permit us to collect for order fulfillment and delivery coordination.

Information from participating courses and service providers

We may receive information from participating golf courses, their food-and-beverage operators, payment processors, communications providers, analytics providers, and other vendors involved in processing or fulfilling an order.

2. How We Use Information

We may use information to:

  • Provide, operate, maintain, and improve the Services;
  • Process orders and payments;
  • Coordinate delivery to an upcoming hole or other designated location;
  • Send verification codes, order confirmations, receipts, status updates, delivery messages, and customer-support communications;
  • Send promotional communications only when permitted by law and consistent with your choices;
  • Personalize menus, content, and user experience;
  • Respond to questions, feedback, and support requests;
  • Detect, investigate, and prevent fraud, misuse, security incidents, and other harmful activity;
  • Measure performance, troubleshoot problems, and develop new features;
  • Enforce our Terms & Conditions and protect users, participating courses, OnCourse Eats, and others; and
  • Comply with legal obligations and respond to lawful requests.

3. Text Messaging and Mobile Information

If you provide a mobile number and consent to receive text messages, OnCourse Eats may send verification codes, order confirmations, receipts, order-status updates, delivery coordination messages, customer-support messages, and, only if you separately opt in, promotional messages.

Message frequency varies based on your orders, account activity, support requests, and messaging preferences. Message and data rates may apply. You may opt out of text messages by replying STOP and request help by replying HELP or emailing jason.barrera@oncourseeats.com. Consent to receive promotional texts is not a condition of purchase.

We do not sell, rent, or share mobile numbers, SMS opt-in data, or text-message consent information with third parties or affiliates for their marketing or promotional purposes. We may disclose this information only to participating courses and service providers or subcontractors that need it to fulfill orders, coordinate delivery, provide messaging or customer support, protect the Services, or perform other operational services on our behalf, and only for those purposes. All other categories of information sharing described in this Privacy Policy exclude mobile numbers, SMS opt-in data, and text-message consent information unless disclosure is required by law or necessary to protect rights, safety, or security.

4. How We Disclose Information

We may disclose information in the following circumstances:

  • Participating courses and food-and-beverage operators. We provide the information needed to accept, prepare, fulfill, deliver, support, and reconcile your order.
  • Service providers. We use vendors for payment processing, text and email communications, hosting, analytics, customer support, fraud prevention, security, and other business operations. These providers may process information only to perform services for us, subject to appropriate contractual restrictions.
  • Legal and safety purposes. We may disclose information if we believe it is reasonably necessary to comply with law or legal process; enforce agreements; detect or prevent fraud, security, or technical issues; or protect the rights, property, or safety of OnCourse Eats, users, participating courses, or others.
  • Business transfers. Information may be disclosed in connection with an actual or proposed merger, financing, acquisition, reorganization, bankruptcy, or sale of some or all business assets, subject to applicable law.
  • With your direction or consent. We may disclose information when you direct us to do so or provide consent.
  • Aggregated or deidentified information. We may disclose information that cannot reasonably be used to identify you.

We do not sell personal information for money. We also do not use or disclose mobile numbers or SMS consent data for cross-context behavioral advertising.

5. Cookies and Analytics

We may use cookies, pixels, local storage, and similar technologies to keep the Services functioning, remember preferences, understand usage, measure performance, prevent fraud, and improve the Services. Our analytics or hosting providers may collect information through these technologies on our behalf.

You may be able to limit cookies through your browser settings. Blocking certain technologies may affect how the Services work. We will provide any consent or opt-out controls required by applicable law.

6. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, fulfill orders, maintain business and tax records, resolve disputes, enforce agreements, prevent fraud, and comply with legal obligations. Retention periods vary depending on the type of information, our operational needs, and applicable law.

When information is no longer needed, we may delete, deidentify, or securely dispose of it. Backup copies may remain for a limited period before being overwritten.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no online service, transmission, or storage system is completely secure, and we cannot guarantee absolute security.

You are responsible for maintaining the security of your device and any account credentials or verification codes. Do not share verification codes with anyone.

8. Your Choices and Privacy Rights

Depending on where you live, you may have rights to request access to, correction of, or deletion of personal information; obtain a portable copy; limit or object to certain processing; or appeal a decision concerning a privacy request. You may also have the right not to receive discriminatory treatment for exercising a privacy right.

To submit a request, email jason.barrera@oncourseeats.com. We may need to verify your identity before completing a request. Where permitted by law, an authorized agent may submit a request on your behalf, subject to verification of the agent’s authority and your identity.

You can unsubscribe from promotional email using the link in the message. You can opt out of text messages by replying STOP. After opting out, we will not send additional text messages unless you later provide consent again or the message is otherwise permitted by law.

9. California Privacy Notice

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, if and when that law applies to OnCourse Eats. These may include rights to know, access, correct, or delete personal information; receive information about categories of collection, use, and disclosure; opt out of certain sales or sharing; limit certain uses of sensitive personal information; and receive equal service and pricing when exercising privacy rights.

The categories of personal information we may collect are described in Section 1. The business and commercial purposes for using that information are described in Section 2, and the categories of recipients are described in Section 4.

OnCourse Eats does not sell personal information for money. If our practices change in a way that constitutes “selling” or “sharing” under California law, we will update this Privacy Policy and provide required opt-out methods before engaging in that activity.

10. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 provided personal information to us, contact us so we can take appropriate action.

11. Third-Party Services

The Services may contain links to or integrate with participating courses, payment processors, communications providers, and other third-party services. Their privacy practices are governed by their own policies, and this Privacy Policy does not apply to information they collect independently for their own purposes.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version with a revised effective date and provide any additional notice required by law. Your continued use of the Services after an update is subject to the revised policy.
